CBD has long been lumped together under the umbrella of cannabis. Many corporations and governments fail to separate their regulations regarding psychoactive THC versus non-psychoactive CBD.
Whether or not you can get fired for using CBD is a growing and evolving discussion with no single answer. If you’re unsure if your workplace allows CBD, or if it includes CBD in its drug test requirements, we encourage you to learn as much as you can in order to understand state and federal regulations as it pertains to your job.
International CBD laws get incredibly complex. For the purposes of this article, we’ll stick to the United States only. Here’s all you need to know about using CBD at work under United States law.
It’s important to realize that full-spectrum CBD oil contains trace amounts of THC. THC is a controlled substance in most states, and laws surrounding it can be strict. For some employers, if any amount of THC whatsoever is detected in your system, your employment could be jeopardized.
In 2019, a woman in North Carolina was fired for using CBD at work when she tested positive for THC. However, when she took the case to court, the judge sided with her under the premise that CBD oil that contains less than 0.3 THC is legal under North Carolina law.
Other cases are not so fortunate. In Utah, a school bus driver who used CBD oil to alleviate symptoms of blood cancer was fired after she tested positive for THC. She said she had never used marijuana, and she was unaware that her product contained THC. This is why it’s important to do thorough research and understand what it is you’re taking.
The answer is not cut and dry, because employment laws vary per state and by contract.
If your state has at-will employment, your employer can terminate your employment at any time, for any reason, without notice. (Likewise, an employee can quit at any time, for any reason, without notice). Your contract should clearly specify if you’re an at-will employee.
Research drug laws in your individual state. Employment and drug law vary widely, especially when it comes to cannabis. These laws are also changing and evolving rapidly, so keep up with the news regularly. We can’t stress enough how important it is to do research on a state and local level, not just a federal level!
Like any supplement or medication, CBD has different effects on different people. If the type or quantity of CBD you use makes you lethargic, we naturally do not recommend using CBD at work. (And your employer won’t, either!)
Whether or not this is a good choice for you comes down to the effect it has on your endocannabinoid system. If CBD helps you manage pain, anxiety, or other symptoms with virtually no debilitating side effects, it may be highly beneficial for you in order to stay productive and focused.
So long as you’re not breaking your contract or the law, using CBD at work comes down to how it affects you personally. Test how CBD affects you outside of work over the course of at least a few days before trying it in the office.
